Website Terms and Conditions

Version 1.1 · Revised 1 October 2026

These terms govern use of the Xcho public website, enquiries, waitlist and other public-facing Xcho content. Paid or trial use of the Xcho platform is governed by the Xcho Business User Agreement and any accepted order.

1. Who operates Xcho

Xcho is operated by LeadCrowd Limited, a company registered in England and Wales with company number 10963512. Our registered office is The 1812 Building, Wheatley Park, Mirfield, England, WF14 8HE.

In these terms, “Xcho”, “we”, “us” and “our” mean LeadCrowd Limited trading as Xcho.

You can contact us at hello@xcho.ai.

2. Business use only

The Xcho website and platform are intended for legitimate business use. They are not offered to consumers.

If you use the website or make an enquiry for a business, you confirm that you are at least 18 and are authorised to provide the information you submit and to discuss the business’s requirements.

Joining a waitlist, making an enquiry, requesting a demonstration or viewing pricing does not guarantee access, acceptance as a customer, a particular launch date, availability in a particular country or channel or a particular commercial offer.

3. Relationship with the Business User Agreement

These website terms do not by themselves create a paid subscription, free trial or messaging campaign.

Where an enquiry, demonstration or other interactive feature requires acceptance of terms, those terms will be presented before the relevant action in a form that can be retained. A footer link or use of the words business use does not override any mandatory right or convert a consumer into a business customer.

Before a business uses Xcho with real customer or lead data, it must accept the applicable Xcho Business User Agreement and data-processing terms. Standard customers may do this through Xcho’s click-through process. Enterprise customers may have a separate signed order.

If there is a conflict concerning the paid or trial platform, the Business User Agreement and any expressly negotiated Enterprise order prevail over these website terms.

The Privacy Policy explains how LeadCrowd handles personal data. The Cookie Policy explains cookies and similar technologies. Those policies are notices and do not themselves create blanket marketing or messaging consent.

4. What Xcho does

Xcho is AI-assisted business software designed to help businesses engage contacts, qualify interest, manage conversations, hand conversations to people and arrange appointments through supported channels.

At launch, campaign messaging supports SMS and WhatsApp and recipient territories are limited to those enabled by Xcho. Xcho may make additional countries, channels, integrations and features available over time.

Xcho can connect to supported services including Google Calendar, HubSpot, website forms and webhooks and customer-enabled external assistants through MCP. A feature or integration marked as coming soon, beta, pilot, preview or roadmap is not a contractual commitment to deliver it by a particular date.

Xcho does not provide financial, legal, medical, tax or other regulated or professional advice and does not make personal recommendations. It is not a substitute for a customer’s appropriately qualified people, licences, permissions, approvals or supervision.

AI can make mistakes, misunderstand context or produce incomplete information. Website demonstrations and sample conversations are illustrative and are not guarantees of how every live conversation will behave.

An interactive public demonstration, where offered, is for evaluation using synthetic or non-confidential test information. Do not submit real third-party personal data, special-category information, passwords, payment details or confidential business material unless the particular function expressly permits it and the necessary terms and permissions are in place. A demonstration does not send a real campaign, create an actual appointment or make a binding commitment unless that specific live action is clearly identified and expressly authorised. Demo inputs may be processed to provide the interaction and address security or misuse, as described in the Privacy Policy; no permanent archive or production reliability is promised.

Required AI disclosures must not be removed or contradicted. Public AI interactions will carry the disclosure required for the actual deployment and will not intentionally impersonate a human. Xcho is not an emergency or safety-critical service.

5. Customer data and messaging permissions

Businesses using Xcho are responsible for ensuring that the leads and contacts they upload, connect or instruct Xcho to contact have been lawfully obtained and may lawfully be contacted for the intended purpose and channel.

Holding a telephone number, importing a record, having an old enquiry or buying a lead does not automatically prove that a future SMS or WhatsApp message is permitted.

Before campaign activation, a customer must confirm that it holds the permissions required for the recipients, purpose, sender and channel. Xcho may request reasonable evidence or pause activity where there is a reasonable compliance concern. Xcho may rely on the customer’s confirmation and does not undertake a general obligation to independently verify permission for every individual contact.

Those responsibilities continue when contacts are added or a purpose, channel or sender changes. Known opt-outs and suppression instructions must be respected; a campaign confirmation does not create recipient permission or override a restriction.

Customer contacts and conversations are not sold, added to a lead marketplace or reused for unrelated marketing or lead generation.

6. Website information and pricing

We take reasonable care over public website information but it may change as Xcho develops.

Published prices, allowances, examples, savings calculations, typical messaging costs and performance examples must be read with any assumptions and exclusions stated alongside them. Unless expressly stated otherwise, prices are exclusive of VAT.

Standard plan pricing does not include Xcho Messaging. The accepted customer order and Business User Agreement govern the actual subscription, usage tariff, payment terms, cancellation arrangements and any Enterprise commitments.

Examples of contact rates, reply rates, bookings, conversion, cost per booked call or other performance are illustrative only. Xcho does not guarantee sales, bookings, response rates, conversion rates, revenue, commission, lead quality or commercial outcome.

A later website change does not retrospectively change an existing customer’s accepted contractual terms.

7. Responsible website use

You must not use the Xcho website or public services for unlawful, fraudulent, deceptive, defamatory, abusive, harassing or discriminatory purposes.

You must not introduce malicious code, interfere with the website, attempt unauthorised access, circumvent security, access another user’s information or use automated methods in a way that imposes an unreasonable load on the service.

Except to the extent applicable law prevents the restriction, you must not scrape or crawl non-public Xcho material, reverse engineer Xcho, attempt to derive source code, prompts, workflows, model logic or security controls, copy the service for competitive replication or conduct competitive benchmarking intended to reproduce Xcho’s proprietary methods.

You must not use the Xcho name, branding or website content to suggest an endorsement, partnership or authorisation that we have not given.

8. Intellectual property

LeadCrowd and its licensors own or license the Xcho website, platform, branding, software, designs, copy, documentation, workflows, prompts, logic and other intellectual property, except for material expressly identified as belonging to another person.

We give you a limited, revocable, non-exclusive right to view and use the public website for legitimate business evaluation and ordinary business enquiries.

Nothing in these website terms transfers any intellectual property right to you.

Voluntary product feedback may be used to improve Xcho without payment or an obligation to implement it, but this does not license personal data, confidential business information or customer campaign content for unrelated use. A submission does not authorise a public testimonial using your name or logo.

The website may link to third-party websites, suppliers or integrations. Those third parties have their own terms, privacy information and availability.

A link or integration reference is not a guarantee, endorsement or promise that the third-party service will remain available.

LeadCrowd may change or remove third-party references, integrations or dependencies where provider terms, technical access, law, pricing or security requirements change.

10. Availability, security and changes

We may update, maintain, suspend or restrict the public website for operational, technical, security, legal or commercial reasons.

We take reasonable security measures appropriate to the website and service but do not guarantee that any website or internet-connected service is absolutely secure, uninterrupted or error-free.

We do not claim a security certification unless we expressly identify that certification as current.

Roadmaps, previews, demonstrations, feature concepts, sales statements and planned integrations are not binding promises unless expressly included in an accepted customer order.

11. Liability for website use

Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence or any other liability to the extent it cannot lawfully be excluded or limited.

Subject to the previous paragraph and to the fullest extent permitted by law, LeadCrowd is not liable in connection with free public website use for loss of profit, revenue, commission, sales, business, contracts, opportunity, anticipated savings, goodwill or reputation, whether direct or indirect, or for indirect, special or consequential loss.

For free public website use not governed by a paid or trial Business User Agreement, LeadCrowd’s total aggregate liability is limited to £100, subject to the mandatory exclusions from limitation stated above. Paid and free trial platform use is governed by the liability provisions of the applicable Business User Agreement and is not moved into this website-only cap.

12. Privacy, cookies and communications

Our Privacy Policy explains how we use personal data for website enquiries, account administration and other controller activities.

Our Cookie Policy explains cookies, local storage, analytics tags and similar technologies. Google Analytics 4 is treated as optional analytics and is not enabled until the relevant consent is given.

Submitting an enquiry or joining a waitlist allows us to respond to that request. It does not create blanket permission for unrelated marketing.

We may send necessary service communications to Xcho account users. Promotional marketing is handled separately and is subject to applicable marketing rules and opt-out rights.

13. Complaints

Questions or complaints about Xcho can be sent to hello@xcho.ai.

Privacy complaints and rights requests are handled as described in the Privacy Policy.

14. Changes to these terms

We may update these website terms to reflect changes to the website, law, security requirements or our business.

A website-term update does not retrospectively change a customer’s accepted Business User Agreement or create consent that was not otherwise obtained.

The revision date identifies this version, which applies when published or from a later stated date. Changes to a paid or trial agreement take effect only through its acceptance or change process. Historical accepted terms are not replaced solely by changing the public website.

Material changes to paid or trial platform contracts are handled under the applicable Business User Agreement.

15. General

These terms and the documents expressly referred to in them are the entire agreement concerning free public website use.

No failure or delay by LeadCrowd in enforcing a right is a waiver. If a provision is unenforceable, it will be modified or severed to the minimum extent necessary and the remaining provisions continue.

LeadCrowd may transfer these website terms as part of a group reorganisation or sale or transfer of the Xcho business.

Neither party is liable for delay or failure caused by events beyond its reasonable control to the extent permitted by law.

16. Governing law and jurisdiction

These website terms are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction over disputes arising from these terms, subject to any jurisdictional rule that cannot lawfully be excluded.
